1. Acceptance of Terms
Welcome to the platform operated by WEBTOPIA SERVICES PRIVATE LIMITED ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, mobile application, and services (collectively, the "Platform").
By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our [Privacy Policy]. If you do not agree to these Terms, you may not access or use the Platform.
"Customer," "You," "Your" refers to any person who accesses or uses the Platform to place an order for Products.
"Delivery Partner" refers to the third-party individuals or entities engaged by the Company to deliver the Products to the Customer.
"Products" refers to the goods, including but not limited to groceries, food, and other items, made available for purchase on the Platform by our retail partners ("Partners").
"Order" means a request placed by a Customer for the delivery of Products.
Service Promise: We strive to deliver your Order within 30 minutes ("Promised Delivery Time") from the time your Order is confirmed. However, this is a target and not a guaranteed delivery time.
Factors Beyond Our Control: The actual delivery time may vary due to factors beyond our reasonable control, including but not limited to:
Traffic conditions, weather, and road closures.
Availability of Delivery Partners.
Accuracy of the delivery address provided by you.
Delays in order processing at the Partner store.
Your availability to accept the delivery at the specified time.
No Liability for Delay: The Company shall not be held liable for any loss or damage suffered by you due to a delay in delivery. A delay in delivery does not entitle you to cancel the Order or refuse to accept the delivery.
Eligibility: You must be at least 18 years of age and capable of entering into a legally binding contract to use the Platform.
Account Accuracy: You are responsible for providing accurate, current, and complete information during the registration process and for updating such information to keep it accurate.
Account Security: You are responsible for safeguarding your account password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
Product Information: We attempt to display Product information (including prices, images, and descriptions) as accurately as possible. However, we do not guarantee the accuracy or completeness of such information. Prices and availability are subject to change without notice.
Order Confirmation: Your order is confirmed only when you receive a confirmation notification/SMS on the Platform. We reserve the right to refuse or cancel any order before delivery for reasons including but not limited to: Product unavailability, pricing errors, or suspected fraudulent activity.
Pricing: The final price charged will include the cost of the Products, applicable taxes, and a delivery fee. All prices are listed in Indian Rupees (₹).
Payment Methods: You can pay for Orders using various methods available on the Platform (e.g., UPI, Credit/Debit Cards, Net Banking, Wallets).
Pre-authorization: Some payment methods may result in a pre-authorization hold on your funds. This is not a charge but may temporarily reduce your available balance.
Refunds: Refunds, if applicable as per our Refund Policy, will be processed to the original payment method used for the transaction.
Delivery Address: You are responsible for providing the correct and complete delivery address. We are not liable for deliveries made to an incorrect address provided by you.
Unsuccessful Deliveries: If a delivery is unsuccessful due to your unavailability, providing a wrong address, or refusal to accept the Order, you will still be charged for the full Order amount. A re-delivery may be attempted at an additional charge, subject to our discretion.
Proof of Delivery: The Delivery Partner may require an OTP or signature as proof of delivery. You agree to provide this to complete the delivery.
Our Returns and Refund policy is governed by our separate [Return & Refund Policy]. Generally, returns are accepted for specific reasons such as:
Product being damaged, expired, or defective upon delivery.
Incorrect Product delivered.
You must report such issues within a short time window (e.g., 30 minutes) of delivery through the Platform's customer support.
You agree not to:
Use the Platform for any illegal or unauthorized purpose.
Harass, threaten, or abuse our employees, Delivery Partners, or other users.
Interfere with or disrupt the integrity or performance of the Platform.
Use the Platform to place Orders for commercial resale.
All content on the Platform, including text, graphics, logos, and software, is the property of WEBTOPIA SERVICES PRIVATE LIMITED or its licensors and is protected by intellectual property laws. You are granted a limited license to use the Platform for personal, non-commercial use.
To the fullest extent permitted by law, WEBTOPIA SERVICES PRIVATE LIMITED, its directors, employees, and Delivery Partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or other intangible losses, resulting from:
Your use or inability to use the Platform.
Any delay or failure in performance of the 30-minute delivery.
The quality, safety, or fitness of the Products sold by our Partners.
Any conduct or content of any third party (including Partners) on the Platform.
Our total cumulative liability to you for any claim arising from these Terms or the use of the Platform shall not exceed the greater of (a) the total amount you paid to us in the 30 days preceding the event giving rise to the claim, or (b) ₹1000.
You agree to indemnify and hold harmless WEBTOPIA SERVICES PRIVATE LIMITED and its affiliates from any claim, demand, loss, or damage, including reasonable attorneys' fees, arising out of or related to your use of the Platform, your violation of these Terms, or your violation of any rights of another.
We may suspend or terminate your account and access to the Platform at our sole discretion, without notice or liability, for any reason, including if you breach these Terms.
Governing Law: These Terms shall be governed by and construed in accordance with the laws of India.
Jurisdiction: The courts in [City, State, e.g., Bangalore, Karnataka] shall have exclusive jurisdiction over any disputes arising under these Terms.
Grievance Officer: In accordance with the Information Technology Act, 2000, you may contact our Grievance Officer at [Insert Grievance Officer Email Address] for any complaints or concerns.
We reserve the right to modify these Terms at any time. We will notify you of changes by posting the new Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms.
